Terms of Use

The website you’re visiting—including any subdomains, related sites, mobile versions, and services made available through it (collectively, the “Site”)—is owned and operated by Timewarp (“Timewarp,” “we,” “our,” or “us”). These Terms of Use (the “Terms”) govern your access to and use of the Site.

By accessing or using the Site, you represent and warrant that you have the authority and capacity to enter into these Terms and you agree to be bound by them, together with our [Privacy Policy] (the “Privacy Policy”), which is incorporated by reference.

If you are under 18, a parent or legal guardian must review and accept these Terms on your behalf before you use the Site. If you do not agree to these Terms, or you are under 18 and your parent or guardian has not agreed to them, do not use the Site. The Site is not intended for children under 13; do not use the Site if you are under 13.

Your continued use of the Site means you accept these Terms.

We may update, suspend, or discontinue any part—or all—of the Site at any time, with or without notice. We may also revise these Terms or add new terms at our discretion. Changes take effect when posted to the Site. Any use of the Site after revised Terms are posted constitutes your acceptance of those changes. No modification by you is binding unless signed in writing by a duly authorized officer of Timewarp.

2. Term and Termination

These Terms apply while you use the Site. We may terminate or suspend your access to the Site, or terminate these Terms as to you, at any time and for any reason, including if you violate these Terms. Upon termination, you must stop using the Site and any content obtained from it. Sections 5–16 of these Terms, and any rights granted by you to Timewarp, will survive termination. We may retain or delete personal data in accordance with law and our Privacy Policy.

3. License and Ownership

Limited License. Subject to these Terms, Timewarp grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use.

Ownership and Restrictions. The Site, including all text, designs, images, videos, software, files, and other materials (collectively, “Content”), is owned by Timewarp or its licensors and is protected by intellectual property and other laws. Except as expressly permitted in these Terms, you may not copy, reproduce, adapt, modify, publish, distribute, sell, lease, publicly display or perform, create derivative works from, reverse engineer, decompile, or otherwise exploit the Site or Content. Do not remove or alter any copyright, trademark, or proprietary notices. You also agree not to use automated tools (such as bots, spiders, or scrapers) to access or copy the Site or Content, unless we provide prior written consent.

4. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. YOUR USE OF THE SITE IS AT YOUR SOLE RISK. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITE OR CONTENT WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS OF IMPLIED WARRANTIES; IN SUCH CASES, THESE EXCLUSIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

5. Acceptable Use and Prohibited Conduct

  • Infringe, misappropriate, or violate any third party’s intellectual property, privacy, publicity, or other rights.

  • Violate any applicable law or regulation.

  • Post content that is defamatory, harassing, hateful, obscene, or otherwise objectionable.

  • Upload malware, viruses, worms, or harmful code.

Additionally, you agree not to:

  • Upload or download content you know or should know you are not legally permitted to obtain.

  • Interfere with, disrupt, or overburden the Site or its infrastructure.

  • Collect or store personal data about users without lawful permission.

  • Access the Site after your authorization has been suspended or terminated.

  • Alter how the Site is displayed except via personal device settings.

  • Use automated means to access the Site or harvest Content without consent.

  • Modify or create variations of Timewarp’s name, logos, or trademarks.

  • Forge headers or manipulate identifiers to disguise the origin of content.

Please notify us of any suspected violations and cooperate with any investigation.

The Site may link to or integrate third-party websites, services, or resources (“Third-Party Links”). We do not control, endorse, or assume responsibility for Third-Party Links. Your use of Third-Party Links is solely at your own risk and subject to the applicable third party’s terms and privacy policies.

Timewarp’s names, logos, service marks, and designs are trademarks or trade dress of Timewarp or its licensors. You may not use them without prior written permission from the applicable rights holder.

9. Notices

We may be required by law to send you certain notices. You agree that posting a notice on the Site or sending a notice to the email address you provided satisfies such requirements. If your contact information is inaccurate or not current, we are not responsible for any missed notices.

10. Governing Law and Venue

These Terms and any dispute arising from or related to them, the Site, or the Content are governed by the laws of the State of Maryland, without regard to conflict-of-laws principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Baltimore County, Maryland, and waive objections to such jurisdiction and venue, including claims of inconvenient forum.

The Site is intended for users in the United States. Do not use the Site where doing so would be unlawful or restricted.

11. Users Outside the United States; Export Controls

If you are located in a country embargoed by the United States or are otherwise prohibited under U.S. export laws (including individuals on U.S. government restricted lists), you may not use the Site or related services for commercial purposes, and you agree not to use the Site in violation of any applicable export control laws.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TIMEWARP OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR PARTNERS (COLLECTIVELY, THE “TIMEWARP PARTIES”) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA) ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR CONTENT, EVEN IF FORESEEABLE OR IF A TIMEWARP PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR ACCESS TO AND USE OF THE SITE IS AT YOUR OWN RISK, AND YOU ARE RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR SYSTEM OR LOSS OF DATA.

IF, NOTWITHSTANDING THE FOREGOING, A TIMEWARP PARTY IS FOUND LIABLE TO YOU FOR ANY DAMAGES, THE TOTAL LIABILITY OF THE TIMEWARP PARTIES FOR ALL CLAIMS WILL NOT EXCEED USD $100 IN THE AGGREGATE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON CERTAIN DAMAGES; WHERE PROHIBITED, THESE LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to defend, indemnify, and hold harmless the Timewarp Parties and our vendors, sponsors, and partners from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your breach of these Terms or applicable law; (b) your use of the Site or Content; (c) your infringement or misappropriation of any third-party right; or (d) your tortious conduct. We may assume the exclusive defense and control of any matter subject to indemnification; if we do, you remain responsible for all costs and damages other than our own legal fees.

14. Miscellaneous

These Terms constitute the entire agreement between you and Timewarp regarding the Site and supersede all prior or contemporaneous understandings on this subject. Our failure to enforce any provision is not a waiver. Section headings are for convenience only. If any provision is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force. The following Sections survive termination: 5 (License and Ownership), 6 (Acceptable Use), 6–8 (IP and Third Parties), 10–16 (Governing Law, Export, Disclaimers, Liability, Indemnity, Miscellaneous).
